Mad Ants Teamwork Tuesday Scavenger Hunt Contest OFFICIAL RULES

Promoter/Sponsor of this Mad Ants Teamwork Tuesday Scavenger Hunt Contest is Pacers Basketball Development, LLC d/b/a Fort Wayne Made Ants (“Mad Ants”), with an address of 1910 St. Joe Center Road, Suite 61, Fort Wayne, IN 46825 and Co-Sponsor is Pizza Hut of Fort Wayne, Inc. (“Pizza Hut”), with an address of 202 West Berry St. Suite 400, Fort Wayne, IN, 46802. All participants agree to be bound by the terms and conditions provided in these Official Rules as well as by all interpretations of these Official Rules by Mad Ants and by all other decisions of Mad Ants, including resolution of disputes in connection with this contest, which are final and binding in all matters relating to the Mad Ants Teamwork Tuesday Scavenger Hunt Contest.

No purchase necessary to participate or win a prize.

 

ELIGIBILITY

The Mad Ants Teamwork Tuesday Scavenger Hunt Contest is open to legal residents of Indiana who are at least eighteen (18) years of age or older at the time of participation. Employees and immediate families of employees (spouse, parents, siblings, and children) of Pizza Hut, Mad Ants, Pacers Basketball, LLC d/b/a Indiana Pacers and Pacers Sports & Entertainment (“Pacers”), the NBA Development League, LLC (“NBADL”), the National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates and related entities, as well as each of the aforementioned parties’ respective directors, officers, owners, members, employees and agents are not able to enter or win.

 

Contest Period

The Mad Ants Teamwork Tuesday Scavenger Hunt Contest begins on May 5, 2020 at 10:00 AM Fort Wayne time and will end on May 5, 2020 when the prize has been won or 5:00 PM Fort Wayne time, whichever comes earlier (the “Contest Period”).

 

HOW TO PARTICIPATE

To participate during the Contest Period, participants should (i) follow @fortwaynemadants and @pizzahutfortwayne on Instagram; (ii) take one (1) photo with the following six (6) items from around their house in the photo: 1) pizza cutter 2) pizza pan 3) oven mitt 4) pizza sauce 5) any pizza toppings/ingredients and 6) item with a Mad Ants logo on it; and (iii) post the photo on your Instagram account using the hashtag #MadAntsTeamworkTuesdayContest and tag @fortwaynemadants and @pizzahutfortwayne in the post. In order to win the prize, participant must be the first person to successfully post a photo on Instagram with all six (6) items included, in accordance with these official rules.

Participant must have an Instagram account to participate. If a participant does not have an account, there is no cost to create one. To create an Instagram account from the Instagram app, download the Instagram app for Apple iOS from the App Store or Android from the Google Play Store. Once the app is installed, tap the Instagram icon and follow the onscreen registration instructions. To create an Instagram account from a computer, go to www.instagram.com and follow the onscreen registration instructions. Participant must agree to comply with Instagram’s Terms of Use and Community Guidelines in order to create and maintain an Instagram account. Limit one (1) entry per person.

Due to the way Instagram operates its service, Mad Ants may not receive entries from Instagram users with “private” posts. Entrants must continue to follow @MadAnts on Instagram through the Entry Period and for at least thirty (30) days thereafter (for potential notification purposes) to participate in the contest and be eligible to win. All posts and/or comments in connection with this contest must NOT, in the sole discretion of the Mad Ants, (i) contain language that violates or infringes upon another’s rights, including but not limited to privacy, publicity or intellectual property rights (including, without limitation, trademark or copyright infringement); (ii) contain language that is inappropriate, indecent, obscene, profane, hateful, tortious, defamatory, slanderous, controversial or libelous; (iii) contain language that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and (iv) contain language that is unlawful, in violation of or contrary to applicable laws or regulations.

 

WINNER SELECTION

There will be one (1) winner of this contest. The first person to post a photo on Instagram in accordance with the “How to Participate” section above and these official rules will be named the winner of this contest and awarded the prize.  In the event the winner cannot be contacted within 72 hours of the initial email or phone notification or declines the prize, another winner will be selected based on the same criteria used to select the initial winner.

It is the sole responsibility of the participant to notify the Mad Ants if his or her contact information and/or e-mail address changes. To do so, send an e-mail to ticketing@ftwaynemadants.com with the new contact information. Mad Ants, Pizza Hut, Pacers and/or the NBADL, National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates, directors, officers, owners, shareholders, members, employees sponsors, licensees, successors, assigns and agents are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of Mad Ants and will not be returned.

Winners may be required to sign an Affidavit of Eligibility and Release attesting to the fact that he/she is 18 years of age or older, as well as other terms and conditions as designated by Mad Ants and consent to the use of his/her likeness in order to collect a prize.

 

PRIZE DESCRIPTION

The prize winner will receive a coupon for one (1) Large Pizza from Pizza Hut ($15.49 value), and a Mad Ants swag bag that includes a Mad Ants winter hat ($12 value), Mad Ants scarf ($12 value), and Mad Ants koozie ($1 value) . Total retail value of prize is $40.49.

 

TAXES

The prize winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the contest, unless otherwise indicated. No substitution, cash equivalent or transfer of prize permitted except at the Pacers option for a prize of comparable or greater value.

 

RELEASE OF LIABILITY AND INDEMNIFICATION

By participating, each participant agrees to follow the Mad Ants Teamwork Tuesday Scavenger Hunt Contest Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that participant may have or that may arise against Instagram, Pizza Hut, Mad Ants, Pacers, NBADL, and/or the National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates and related entities, as well as each of the aforementioned parties’ respective directors, officers, owners, shareholders, members, employees, representatives, successors, assigns and agents (collectively, the “Released Parties”), with respect to or arising out of either (i) participant’s participation; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in the contest. By participating, each participant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and/or other legal fees) they may incur as a result of claims made against them in connection with either (i) participant’s participation; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in the contest.

This promotion is in no way sponsored, endorsed, or administered by, or associated with Instagram. You understand that you are providing your information to Mad Ants and not to Instagram.

 

PUBLICITY RELEASE:

Except where prohibited by law, in consideration for being permitted to participate in this contest and the opportunity to win the prizes offered in this contest, each participant hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of the participant’s name, likeness, voice, photograph, performance, photo submission, personal statements and/or biographical information in any and all advertising, promotions and other publicity conducted by Pizza Hut, Mad Ants and/or Pacers, NBADL, the National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates, agents, licensees, successors and assigns.

 

CONTEST CANCELLATION, SUSPENSION OR MODIFICATION

Mad Ants reserves the right to cancel, modify or suspend the contest and/or change dates or prizes (to a prize of equal or greater value) relating to the promotion in case of schedule changes, acts of God, force majeure events, computer viruses, bugs, corruption or unfairness of the security or administration of the contest, or for any other reason at the sole discretion of the Mad Ants.
